FREDDIE MAC GATEWAY TERMS AND CONDITIONS (“TERMS”)

PLEASE READ THE FOLLOWING. IT SETS OUT THE TERMS THAT APPLY TO YOUR ACCESS TO AND USE OF CERTAIN FREDDIE MAC SINGLE-FAMILY TECHNOLOGY, INCLUDING THE SYSTEMS, TOOLS AND APPLICATIONS MADE AVAILABLE VIA FREDDIE MAC GATEWAY (“LICENSED SYSTEMS”).

By clicking the "Sign On" button on the login page for Freddie Mac Gateway, or by accessing or using any Licensed System, you are agreeing on your behalf, and also on behalf of the organization that employs you or on whose behalf you are acting (your “Organization”), to be bound by these Terms. If you do not agree to these Terms, do not access or use the Licensed Systems.

1. Applicable Terms for Seller/Servicers: If you are accessing a Licensed System on behalf of or using login credentials associated with a Freddie Mac Seller/Servicer (i.e., an institution approved to sell mortgages to Freddie Mac and/or service mortgages purchased by Freddie Mac), your access is governed by the Freddie Mac Single-Family Seller/Servicer Guide (“Guide”) and any other applicable Purchase Documents (as defined in the Guide) pertaining to the Licensed Systems, as may be amended from time to time.
2. Applicable Terms for Mortgage Insurers: If you are accessing a Licensed System on behalf of or using login credentials associated with a Freddie Mac-approved mortgage insurer (a “Mortgage Insurer”), your access is governed by the terms of that Mortgage Insurer’s applicable agreement(s) with Freddie Mac pertaining to such Licensed System(s), as may be amended from time to time.
3. Applicable Terms for Other Organization Types: If you are accessing a Licensed System and neither paragraphs 1 or 2 above apply, then (a) your access is governed by the Related Third Party Agreement, as may be amended from time to time by Freddie Mac (including via posting of such updated terms to the foregoing hyperlinked webpage or any successor site to that webpage), and (b) if your Organization has not previously bound itself to the Related Third Party Agreement, then on behalf of yourself and your Organization, you are agreeing to be bound by the Related Third Party Agreement, as may be amended from time to time by Freddie Mac (including via posting of such updated terms to the foregoing hyperlinked webpage or any successor webpage to that webpage).

NOTE: The use of headings in these Terms is only for ease of reference, and the headings have no legal effect and are not to be considered part of the Terms.
