Approved Community Land Trust Non-Model Ground Leases

Section 4502.7 of the FHLMC Seller/Servicer Guide requires the Seller to “review and determine that the Community Land Trust's Ground Lease conforms to either the National Community Land Trust Network (NCLTN) 2011 Community Land Trust Network Model Ground Lease or the Institute for Community Economics (ICE) Model Ground Lease. Optional language as provided in either of such models must be selected but no additional changes may be made without Freddie Mac's prior written approval.” All efforts should be made to have the Community Land Trust adopt a Ground Lease which matches either one of the models.  Approvals, for Ground Leases not meeting the model standards (aka. Non-Model Ground Leases), are issued only after rigorous review and on an exception basis.

Approval of the Non-Model Ground Lease does not relieve the Seller from representations and warranties that the Community Land Trust Ground Lease is valid, enforceable and in full force and effect as per Guide Section 4502.7

Approved Sellers may use the provision titled, “Community Land Trust Non-Model Ground Lease” to originate and sell mortgages to Freddie Mac in connection with the approved Community Land Trust Non-Model Ground Leases listed below.
